FAQs 6

Are bifacial solar panels exempt from tariffs?

Bifacial solar panels — panels that produce solar power on both sides — were exempt from the tariffs. The safeguard measure imposed in 2018 consisted of a 30% additional tariff on CSPV products, which was set to decline by 5% each year.

Will bifacial solar panels be exempt from the safeguard measure?

The Proclamation also preserves the exemption of bifacial solar panels from the safeguard measure, and authorizes the US Trade Representative (USTR) to negotiate agreements with Canada and Mexico that could lead to the exclusion of those countries from the safeguard remedy. This alert provides an overview of the Proclamation.

Will bifacial solar panels lose exemption?

In addition to bifacial panels losing their exemption, the Biden Administration said it will raise the tariff-rate quota (TRQ) of silicon solar cells by 7.5 GW, if needed.

When can I import bifacial solar panels?

The affected solar cells and modules are classified under the following Harmonized Tariff Schedule (HTS) codes: Importers who signed contracts by May 16, 2024, may import bifacial solar panels without Section 201 duties from June 26, 2024, to September 23, 2024, provided the contract terms have not changed.

Will bifacial solar importers be able to certify pre-existing contracts?

The Biden Administration is providing a slight safeguard to bifacial importers. Those with pre-existing contracts for bifacial solar modules to be delivered within 90 days of today’s exclusion removal will be able to certify those contracts to continue using the exclusion for that period.

Why are bifacial panels exempt from tariffs?

Bifacial panels were originally exempt from the tariffs because there was no significant domestic manufacturing capacity of the specialty product. This caused more bifacial modules to be imported into the United States than monofacial panels, undermining the objectives of the original safeguard measure.
